Terms and Conditions
These Terms and Conditions apply to all contracts between AnrufPro and the customer regarding the use of the AI phone assistant.
1. Scope
These Terms apply to all services provided by AnrufPro as part of the AI phone assistant. Deviating terms of the customer are not recognized unless AnrufPro expressly agrees to them in writing.
2. Service Description
AnrufPro provides an AI-powered phone assistant that answers incoming calls, responds to customer questions, and books appointments. The scope of services depends on the selected plan. The service is generally available 24 hours a day, 7 days a week. AnrufPro guarantees an availability of 99.5% on an annual average. Scheduled maintenance will be announced at least 48 hours in advance.
3. Contract and Duration
The contract is concluded upon ordering the service and confirmation by AnrufPro. • Monthly billing: The contract automatically renews for one month at a time and can be cancelled at any time effective at the end of the month. • Annual billing: The contract automatically renews for one year at a time and can be cancelled with 30 days' notice before the end of the year. Cancellation can be sent via email to info@anrufpro.de.
4. Prices and Payment
Current prices are available on the AnrufPro website. All prices are in euros and include statutory VAT. Payment is made by credit card or direct debit. In case of late payment, AnrufPro is entitled to suspend access to the service after prior notice.
5. Setup and Onboarding
The one-time setup fee covers the configuration of the assistant, training on the customer's services and frequently asked questions, and the technical connection to the existing phone number. The customer provides the information required for setup (services, prices, opening hours, frequently asked questions) in a timely manner.
6. Customer Obligations
The customer agrees to: • Provide current and accurate business information • Communicate changes to services, prices, or opening hours promptly • Not use the service for unlawful purposes • Set up or have set up the call forwarding correctly
7. Liability
AnrufPro is fully liable in cases of intent and gross negligence. In cases of slight negligence, AnrufPro is only liable for the breach of essential contractual obligations, limited to foreseeable, contract-typical damages. AnrufPro is not liable for lost business or lost profits due to technical failures beyond AnrufPro's control.
8. Intellectual Property
All rights to the software, AI model, and technology of AnrufPro remain with AnrufPro. The customer receives a non-exclusive, non-transferable right of use for the duration of the contract. Business information provided by the customer (services, prices, FAQ) remains the property of the customer. AnrufPro uses this information solely for the provision of the service.
9. Scope of Service and Disclaimer
The AI phone assistant answers calls based on information provided by the customer. AnrufPro does not guarantee that every inquiry will be answered correctly or completely. The assistant is not a substitute for medical, legal, or other professional advice. The customer is responsible for ensuring the accuracy of the information provided to the assistant.
10. Termination by AnrufPro
AnrufPro is entitled to terminate the contract with immediate effect if the customer: • Uses the service for unlawful or fraudulent purposes • Violates essential provisions of these Terms • Remains in default of payment despite a reminder In the event of termination by AnrufPro due to breach of contract, there is no entitlement to a refund of amounts already paid.
11. Data Protection
The processing of personal data is carried out in accordance with AnrufPro's Privacy Policy and in compliance with GDPR.
12. Right of Withdrawal
Consumers have the right to withdraw from the contract within 14 days without giving reasons. The withdrawal period is 14 days from the date of the conclusion of the contract. To exercise the right of withdrawal, send an email to info@anrufpro.de with a clear statement of your decision to withdraw from the contract. Additionally, AnrufPro offers a 14-day money-back guarantee from the activation of the service.
13. Changes to Terms
AnrufPro reserves the right to amend these Terms with effect for the future. Changes will be communicated to the customer by email. If the customer does not object within 30 days, the new Terms are deemed accepted.
14. Final Provisions
The law of the Federal Republic of Germany applies. The place of jurisdiction for all disputes arising from this contractual relationship is, to the extent permitted by law, the registered office of AnrufPro. If individual provisions of these Terms are invalid, the validity of the remaining provisions remains unaffected.
